Our Content
The text, photographs, graphics, layout, logos and trade dress on this site belong to Holiday Manor Footwear or are used under license. They may not be copied, republished, scraped, mirrored or used commercially without our prior written permission. Linking to our pages is welcome, and if you want to use something for a legitimate purpose, ask us. We usually say yes.
Third-Party Rights
Product names, brand names and trademarks belonging to others remain the property of their owners. Where such a name appears on this site it is used only to identify or describe a product, and implies no affiliation with, sponsorship by, or endorsement from the rights holder. If you believe a listing suggests a relationship of that kind, tell us and we will correct or remove it.
Reporting an Infringement
If you own a copyright or trademark and believe material here infringes it, send a written notice to [email protected] with the subject line DMCA Notice. Under the Digital Millennium Copyright Act your notice needs to include:
- A physical or electronic signature of the rights owner or a person authorized to act for them.
- Identification of the copyrighted work or trademark you say has been infringed.
- The URL, or a description sufficient for us to locate the material in question.
- Your name, mailing address and email address, and any other contact details at which you can be reached.
- A statement that you believe in good faith that the use is not authorized by the rights owner, its agent or the law.
- A statement, made under penalty of perjury, that the information in the notice is accurate and that you are authorized to act for the rights owner.
An incomplete notice slows things down rather than stopping them. If something on the list is difficult for you to supply, send what you have and we will tell you what else we need.
What Happens Next
We review every properly submitted notice and, where the claim appears valid, remove or disable access to the material promptly. Where the material came from a third party we notify them of the removal and pass on a copy of the notice. We email the complainant to confirm what action was taken.
Counter-Notice
If material of yours was removed and you believe that was a mistake or a misidentification, send a counter-notice to [email protected] containing your signature, identification of the removed material and where it appeared, a statement under penalty of perjury that you believe in good faith it was removed in error, your contact details, and your consent to the jurisdiction of the federal court for the district in which you reside, or of Jefferson County, Kentucky if you reside outside the United States.
Where a valid counter-notice is received we may restore the material after 10 business days, unless the original complainant notifies us that they have filed an action seeking a court order.
Repeat Infringers
Accounts and suppliers that repeatedly infringe the rights of others are terminated, and listings connected to them are removed.
Misrepresentation
Anyone who knowingly makes a material misrepresentation in a notice or counter-notice may be liable for damages under Section 512(f) of the DMCA, including costs and attorney fees.
